Terms and Conditions of Sale — Maison Soleil

1. Preamble and scope

These General Terms and Conditions of Sale (hereinafter the “Terms”) apply to all orders placed by any natural or legal person (hereinafter the “Customer”) on the e-commerce website www.lamaison-soleil.com (hereinafter the “Site”), operated by the company Sunshine Corp SAS, registered with the Trade and Companies Register under number 892 447 013, with its registered office in Marseille (13002), France, hereinafter referred to as “Maison Soleil”.

Placing an order implies full and unreserved acceptance of these Terms, which prevail over any other document of the Customer. Maison Soleil reserves the right to amend its Terms at any time; only the Terms in force on the day of the order apply.


2. Products and services offered

Maison Soleil offers for sale online:

  • whole bean and ground coffee;
  • house blends and limited editions;
  • decaffeinated coffee;
  • compostable capsules and soft pods compatible with the Nespresso and Senseo ;
  • ready-to-drink cold brew beverages;
  • brewing equipment and accessories;
  • branded merchandise;
  • commitment-free monthly subscriptions;
  • gift cards and gift sets.

All of our products are 100% coffee : we do not offer any drink made from chicory, barley, lupin or other substitutes.

The essential characteristics of the products are presented on the Site’s product pages. Maison Soleil strives to ensure the accuracy of photographs and descriptions, although a perfectly faithful reproduction of colours and textures cannot be guaranteed on all screens.


3. Orders

3.1 Ordering process

The Customer selects their products, adds them to the basket, enters their details, chooses the delivery method and proceeds to payment. The order is definitively confirmed once payment has been confirmed.

3.2 Confirmation

A confirmation email summarising the order, the products, the prices, the delivery costs and the delivery address is sent to the Customer as soon as payment is confirmed.

3.3 Refusal or cancellation

Maison Soleil reserves the right to refuse or cancel any order in the event of a previous dispute with the Customer, suspected fraud, product unavailability or a manifest error in the description or price. If a product becomes unavailable after ordering, the Customer is informed by email and refunded without delay.


4. Prices and payment

4.1 Prices

Prices are shown in euros (€) inclusive of all taxes. The applicable VAT rate is the one in force on the day of the order:

  • 5,5 % for coffee, capsules, pods and coffee-based drinks (cold brew);
  • 20 % for equipment, accessories and merchandise.

Mixed products (gift sets containing coffee and accessories) are invoiced according to the applicable mixed VAT rules.

4.2 Delivery costs

Delivery costs are calculated according to weight, volume and destination. They are shown before payment is confirmed.

4.3 Payment methods

Payments are made by bank card (Carte Bleue, Visa, Mastercard) or by any other method offered on the Site. Payments are secured by our payment provider. Maison Soleil does not store bank card numbers.

4.4 Subscriptions

Subscriptions are billed as a recurring monthly charge on the anniversary date of sign-up. The Customer may change, pause or cancel their subscription at any time from their customer account, free of charge and with no justification required. Cancellation takes effect at the next billing date; no refund is made for the current period already invoiced.


5. Delivery

5.1 Delivery areas

Maison Soleil delivers to mainland France, Belgium, Luxembourg, Switzerland, Germany and selected French-speaking African countries. Available destinations are shown at checkout.

5.2 Delivery times

Delivery times are given as an indication only. They run from the confirmation of the order. For subscriptions, shipping takes place each month around the sign-up anniversary date.

5.3 Transfer of risk

Risk in the products passes to the Customer upon handover of the products to the carrier. In the event of delay, damaged parcel or non-receipt, the Customer must contact customer service at bonjour@lamaison-soleil.com within 5 working days of the expected delivery date.

5.4 Receipt

The Customer undertakes to check the condition of the products upon receipt. Any anomaly (missing product, damaged parcel, spoiled product) must be reported by email within 48 hours of receipt.


6. Right of withdrawal

6.1 Principle

In accordance with Articles L. 221-18 et seq. of the French Consumer Code, the Customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to give reasons or pay any penalty.

6.2 Exceptions

The right of withdrawal cannot be exercised for:

  • perishable products or products likely to deteriorate rapidly (whole bean coffee, ground coffee, capsules, pods, cold brew) once the seal has been broken or the product has been consumed;
  • products unsealed or used by the Customer which cannot be returned for reasons of hygiene or health protection;
  • products made to the Customer’s specifications or clearly personalised;
  • services fully performed before the end of the withdrawal period, with the Customer’s prior express agreement.

6.3 How to exercise the right

To exercise their right of withdrawal, the Customer must notify their decision in writing to:

The Customer may use the withdrawal form available in their customer account or at the end of these Terms. Products not covered by the above exceptions must be returned in their original packaging, in perfect condition and accompanied by the invoice, to the address provided by customer service. Return costs are borne by the Customer, except in the case of a defective product or a delivery error on the part of Maison Soleil.

6.4 Refund

Maison Soleil issues the refund within 14 days of receiving the returned products or proof of their dispatch. The refund covers the price of the product and, where applicable, the initial standard delivery costs.


7. Warranties and liability

7.1 Legal warranty of conformity

The products benefit from the legal warranty of conformity provided for in Articles L. 217-4 et seq. of the French Consumer Code, applicable for 24 months from delivery.

7.2 Legal warranty against hidden defects

The products also benefit from the legal warranty against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.

7.3 Liability

Maison Soleil’s liability is limited to the amount of the order concerned, excluding any indirect damage. It cannot be held liable in the event of non-performance or poor performance due to force majeure, an act of the Customer or a delivery error attributable to the carrier.


8. Personal data

The personal data collected when ordering is necessary for processing the order and managing the customer relationship. It is intended for Maison Soleil and its logistics and payment providers. The Customer has the right to access, rectify, erase, restrict and port their data, which they may exercise by contacting bonjour@lamaison-soleil.com. For more information, see our Privacy Policy.


9. Intellectual property

All elements of the Site (texts, photographs, graphics, logo, trademarks) are the exclusive property of Maison Soleil or its partners. Any reproduction, representation or adaptation, in whole or in part, without prior written authorisation, is prohibited.


10. Governing law and dispute resolution

These Terms are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution before any legal action. Failing an amicable agreement, the Customer may use, free of charge, the consumer mediator to which Maison Soleil belongs, whose contact details are available on the Site. The French courts have jurisdiction.
